Terms of Use

These terms are an agreement between you and Aculix Technologies LLP (“Aculix”, “we”, “us”), the company behind CapGen. By creating an account or using capgen.ai, you agree to them. They are written to be read, not skimmed past; the short version is: upload photos you have the right to use, treat the service fairly, and check AI output before you post it.

The service

CapGen reads a photo you upload and generates social media captions for it. Generation runs on credits: one credit reads one photo and produces a set of captions. New accounts start with two free credits; paid plans refill your credit balance every billing cycle. Captions are generated by third-party AI models reached through OpenRouter, our AI routing provider. How we handle your photos is covered in our Privacy Policy, including the fact that we do not use your images to train AI models.

Your account

You need an account to generate captions. Keep your credentials secure and the information on your account accurate. You must be at least 13 years old to use CapGen. You are responsible for activity that happens under your account.

Your content

Your photos are yours. By uploading a photo you give us the limited permission we need to store it and process it in order to run the service: hosting it, sending it to our AI providers to generate your captions, and showing it back to you in your collections. We claim no other rights over your content. You can use the captions CapGen generates for you, personally or commercially, without crediting us.

You agree not to upload content that:

• you do not have the rights or permission to use;
• is illegal, or depicts or exploits minors in any way;
• contains someone else's private information without their consent.

We may remove content or suspend accounts that break these rules, and we report child sexual abuse material to the relevant authorities.

AI output

Captions are generated by AI models. They are usually good and occasionally wrong, strange, or tone-deaf. Review a caption before you publish it; you are responsible for what you post to your own social accounts. AI output may be similar to output generated for other users given similar photos, and we cannot guarantee it is free of third-party rights claims in every jurisdiction.

Credits, billing, and refunds

• Paid plans are billed monthly or yearly through our payment provider, Dodo Payments.
• Your plan refills your credit balance to its cap on every billing cycle. Unused credits do not roll over.
• Upgrades take effect immediately and top your balance up to the new plan. Downgrades take effect at your next renewal.
• You can cancel anytime from Settings. You keep access until the end of the period you already paid for, then billing stops.
• Paid plans have a 14-day money-back window: if CapGen is not a fit, email us within 14 days of your first payment for a full refund.
• Prices may change; we will tell you before a price change affects an active subscription.

Fair use

You agree not to:

• resell, sublicense, or provide the service to third parties as your own;
• access the service by automated means outside the product itself, or attempt to scrape, overload, or disrupt it;
• reverse engineer the service or attempt to extract our prompts, models, or source;
• circumvent credit limits, free-credit grants, or other product boundaries.

Our property

The CapGen product, site, design, and brand belong to Aculix Technologies LLP. These terms do not give you any right to use our trademarks or branding.

Availability and changes

We work to keep CapGen fast and available, but we provide the service “as is” and do not guarantee uninterrupted operation. We may change, add, or remove features, and we may suspend or terminate accounts that violate these terms. If we ever discontinue the service entirely, we will give reasonable notice where practicable.

Liability

To the maximum extent permitted by law, Aculix Technologies LLP is not liable for indirect, incidental, or consequential damages arising from your use of CapGen, and our total liability for any claim is limited to the amount you paid us in the twelve months before the claim arose.

Changes to these terms

We may update these terms from time to time. We will post changes on this page and update the effective date above. Continuing to use CapGen after a change means you accept the updated terms.
